These Terms & Conditions ("Terms") govern your access to and use of the Pamevent website, applications, and services (collectively, the "Platform"). The Platform is operated by Pamevent LLC in the United States and Pamevent in Haiti. By accessing or using the Platform, you agree to be bound by these Terms.
1. Definitions
"Organizer" means the person or entity that creates and hosts an Event on the Platform.
"Customer" means the person or entity that purchases a Ticket to an Event through the Platform.
"Event" means any event listed on the Platform for which Tickets are available for purchase.
"Ticket" means a revocable license to attend an Event.
2. Account Registration
You may be required to create an account to use certain features of the Platform. You are responsible for maintaining the confidentiality of your account information and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.
3. Event Listings and Tickets
Event Information: Organizers are solely responsible for the accuracy and completeness of all information provided for their Events, including but not limited to event descriptions, dates, times, locations, and pricing.
Ticket Purchases: Customers are responsible for reviewing and understanding the terms of the Ticket purchase, including any refund or exchange policies, before completing a transaction. All Ticket sales are final.
Ticket Delivery: Tickets may be delivered electronically or by other means specified by the Organizer.
Ticket Use: Tickets are valid only for the specified Event and may not be transferred or resold.
4. Payments
Payment Processing: All payments for Tickets are processed through a third-party payment processor. Pamevent does not store any payment information.
Currency: All transactions are processed in the currency specified by the Organizer.
Fees: Pamevent may charge fees for the use of the Platform. These fees will be clearly disclosed to you before you complete a transaction.
5. Prohibited Conduct
You agree not to:
Use the Platform for any illegal or unauthorized purpose.
Interfere with or disrupt the Platform or servers or networks connected to the Platform.
Attempt to gain unauthorized access to the Platform or any related systems or networks.
Use any robot, spider, or other automatic device or process to access the Platform for any purpose.
Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity.
Violate any applicable local, state, national, or international law or regulation.
6. Termination
We may terminate your access to the Platform for any reason, at any time, without notice. We may also remove any content or information from the Platform at our sole discretion.
7. Disclaimer of Warranties
The Platform is provided "as is" and without warranty of any kind. We disclaim all warranties, express or implied, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted or error-free, that defects will be corrected, or that the Platform is free of viruses or other harmful components.
8. Limitation of Liability
In no event shall Pamevent be liable for any damages whatsoever, including but not limited to, direct, indirect, incidental, consequential, special, or exemplary damages, arising out of or in connection with your use of the Platform, even if Pamevent has been advised of the possibility of such damages.
9. Indemnification
You agree to indemnify and hold harmless Pamevent, its officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to (a) your use of the Platform, (b) your violation of these Terms, or (c) your violation of any rights of a third party.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New Mexico, without regard to its conflict of laws provisions.
11. Dispute Resolution
Any dispute arising out of or relating to these Terms shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be held in Albuquerque, New Mexico.
12. Entire Agreement
These Terms constitute the entire agreement between you and Pamevent relating to your access to and use of the Platform and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.
13. Amendments
We may amend these Terms at any time by posting the amended Terms on the Platform. Your continued use of the Platform after the posting of the amended Terms constitutes your acceptance of the amended Terms.
